Welcome to Phillin. These terms are an agreement between you and Ashtro, the New Zealand studio that operates Phillin ("Phillin", "we", "us"). By creating an account or using Phillin you accept them.
1. What Phillin is
Phillin connects social sports teams that are short of players ("organisers") with nearby fill-in players ("ringers"). Phillin is a matching platform. Games are organised and run by their organisers, not by Phillin. We do not vet players, organisers, venues or games.
2. Your account
You must be at least 18 years of age to use Phillin. You must provide accurate details and verify your email before joining games. You are responsible for activity on your account and for keeping your password safe. One account per person. You can delete your account and all associated data at any time in the app (Profile, Edit, Delete my profile).
3. Your licence to use the app
This section is an end user licence agreement (EULA) between you and Ashtro only. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Phillin app and website for their intended purpose. You must not copy, modify, sell, rent or redistribute the app, reverse engineer it except where the law allows, scrape or bulk extract data, use another person's account, or interfere with the service or its security.
4. Commitments
Ringing in to a game is a commitment to show up. Withdrawing late, failing to appear, or withdrawing guests affects your XP and reliability score as shown in the app. Ratings are given by organisers and affect your profile. XP, levels, streaks, ratings and reliability are features of the platform, have no monetary value, and can be adjusted or reset by us to keep the system fair.
5. Guests
If you add a guest to a game, you are responsible for them. Guest no-shows and withdrawals count against your own XP and reliability.
6. Playing at your own risk
Sport carries a risk of injury. You take part in games at your own risk. Phillin is not liable for injuries, property loss, venue conditions, or the conduct of other players or organisers.
7. Acceptable use and content
Anything you enter into Phillin (names, team names, game notes, messages to us) must be accurate and must not be offensive, abusive, discriminatory, misleading or unlawful. There is no tolerance for objectionable content or abusive behaviour. We may remove content, and suspend or remove accounts, at our discretion and without notice, including for manipulating XP, ratings or check-ins. To report content or behaviour, email support@phill.in and we will review it promptly.
8. Fees
Phillin is currently free to use. If we introduce paid features we will tell you clearly before you are charged anything.
9. Service and availability
We provide Phillin as is and as available. We do our best to keep it running and accurate, but we do not promise uninterrupted or error-free service, and features may change, be added or be removed.
10. Liability
To the maximum extent permitted by law, Ashtro is not liable for indirect or consequential loss arising from your use of Phillin, and our total liability to you is limited to NZD 100. Nothing in these terms limits rights you have under the New Zealand Consumer Guarantees Act 1993 or any other law that cannot be excluded. If you use Phillin for business purposes, you agree the Consumer Guarantees Act does not apply.
11. Ending your use
You can stop using Phillin and delete your account at any time. We may suspend or terminate accounts that breach these terms. Sections that by their nature should survive termination (including licence restrictions, liability and governing law) survive it.
12. App store terms
If you downloaded Phillin from the Apple App Store: this agreement is between you and Ashtro only, not Apple. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for any product warranties, any claims relating to the app, or any third party claim that the app infringes intellectual property rights. Apple and its subsidiaries are third party beneficiaries of this agreement and may enforce it against you. You must also comply with the Apple Media Services Terms and Conditions. You confirm that you are not located in a country subject to a United States Government embargo and that you are not on any United States Government list of prohibited or restricted parties. If you downloaded Phillin from Google Play, the Google Play Terms of Service also apply.
13. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have exclusive jurisdiction over any dispute.
14. Changes
We may update these terms from time to time. If a change is significant we will tell you in the app or by email. Continued use of Phillin after changes means you accept the updated terms.
